Without a criminal sanction we think the requirement under Clause 752 to provide information or documents in hard copy to an individual member on request has no teeth. A member would be left with no recourse except to take the company to court for an order. We think that a criminal sanction here is proportionate and consistent with that provided under Clauses 409 and 410, which give a member a similar right to ask for a copy of the annual report and accounts. Therefore, I trust that noble Lords will not press the amendment.
