Company Law Reform Bill [HL]

moved Amendment No. A204DA:"Page 464, line 30, after ““website”” insert ““and has agreed to such a request””" The noble Lord said: The purpose of this amendment is to clarify the scope of the provisions in Schedule 6 relating to the agreement to send or supply documents by making them available on a website. We feel that that should not only be deemed where the person fails to respond within 28 days of the company’s request, but also where the person has specifically agreed to it. If the amendment is agreed to, I accept that this applies elsewhere, for example, in paragraph 11(3) of Schedule 6 and paragraph 10(4) of Schedule 7. It seems to us that just to have a default mechanism and not to deem it to be agreed is an omission. I beg to move.
