I believe the position is that it derives from the Section 36 procedure. This is an existing procedure which operates on a devolved basis for projects which are onshore as well as for those in territorial waters. The focus of this order is simply to extend that devolved responsibility in respect of the wider area of the sea that could be encompassed by these arrangements. Nothing has changed on that.
