Scotland Act 1998 (Transfer of Functions to the Scottish Ministers etc.) (No. 2) Order 2006

Will the Minister clarify one or two points for me? I find it interesting that the measure we took through at the end of January, the Renewable Energy Zone (Designation of Area) (Scottish Ministers) Order 2005, merely designated the zone and had nothing whatever to do with electricity generation. This is a follow-up measure we are taking now. At least what we are talking about today presumably does away with any possible confusion that might have arisen between offshore wind farms that were sited on the border of Scottish territorial waters and the renewable energy zone. That now all becomes one. The border that is tricky is the one between Scottish Ministers and UK Ministers as defined in the earlier order. I would be interested to know whether the Government feel this measure is expected to increase the Scottish contribution to renewable energy. I tend to differ a little from the noble Earl, Lord Mar and Kellie, because it seems to me the Scots are making a big effort and showing the way on how much of a contribution renewable energy can make. As I understand it, their target was 40 per cent by 2050, although I may not have the figures quite right. I am always slightly puzzled about what it is 40 per cent of—current generation or future generation. Does it include whether the Scots have plans to continue or renew nuclear generation in Scotland? Does 40 per cent become the figure once nuclear generation in Scotland has gone into desuetude? It is interesting that this measure deals with water. There is a possibility of confusion because Scotland has opted to have a single river basin zone considered as an area under the Water Framework Directive. That river basin zone extends into England in so far as the River Tweed catchment area includes parts of England, so I wonder whether, when looking at regulating water for electricity generation, it will have to extend to that part of England.
