My Lords, I congratulate the noble Baroness, Lady Anelay, on tabling the amendment to secure a review after three years. Many outside this House have been grateful to her for her representations of their concerns. I fully support the amendment, which would give the House an opportunity to return to issues that have clearly been of some contention, and to consider them in the light of experience. I agree with her that the collection of better data on the number of refusals will be central to ensuring that, should any problems emerge with the new system, a management information system is available to help us address issues as they arise.
I was interested in what the noble Baroness said on proposed new paragraph (c) of her amendment, because it appeared to suggest that decisions would be provisional in some way in the first instance—that an entry clearance officer could tell an applicant that they were minded to refuse, and give the applicant an opportunity to object at that point. Is that what she had in mind?
