Clearly the noble Lord has access to enormous legal expertise. I am surprised that the way in which subsection 2)(b) is drafted provides the protection that the amendment seeks to give. However, it is best not to engage in heavy legal argument. We will take further advice in light of the noble Lord’s comments. If we are satisfied, we will leave it alone; if we are not, we will come back to it later. In the mean time, I beg leave to withdraw the amendment.
