The concern here seems to be that ““goodwill”” needs to be defined for the purposes of this clause, just as it is defined in Clause 70, as including ““reputation of any description””. However, subsection (2) refers to Clause 70, specifically to an application under Clause 70. It is important that ““goodwill”” is defined for the purposes of the grounds of such an application—there is no disagreement on that—but it does not need to be defined here as well. It is already covered.
