I draw the noble Baroness’s attention to subsection (11), which says that the redetermination and opening-up of past matters is,"““subject to an express provision to the contrary””." Given the point already made in another place that the Government would not seek routinely to override those matters, it is expected that that power would be used if there is an issue when regulations are made.
