We associate ourselves with the sentiments expressed by the noble Lord, Lord Razzall, about the noble Lord, Lord Borrie. We believe that the amendment is eminently sensible. I suspect it is possible that the Government will say that their own new Section 140A(2) gives the court discretionary power to take into account any factors that it believes are relevant. Am I right in assuming that that would include responsible lending? If so, that would make matters very much easier to understand.
