I hope that I am in order to speak after the Minister. I am heartened to hear the noble Baroness say that it is not the Government’s intention to restrict the circumstances in which the grant of a right to representation shall be taken to be in the interests of justice. It could be made clear quite simply if the wording were changed to something like this: ““The circumstances in which the grant of a right to representation shall be taken to be in the interests of justice shall include such circumstances as may be prescribed””. That would make it absolutely clear that you are not seeking to close this down.
